Can't believe I'm about to type this.
May I take this opportunity to thank ii for his last posting of fact (the chart) and opinion (a big fall) and nothing more. Whether postive or negative, it is conctructive, not spun out of proportion or abusive, or deliberately misleading. This thread has suffered enough from these problems.

I debated for a while whether to post this as I did not wish to start the patent argument going again, but I found it very interesting. I will not enter into a discussion re the pros and cons as I have no views either way, but just read the full article. My only comment is ( note the damages awarded ) and remember this was awarded by a USA court who award in most cases far higher damages than British courts. For those who will find no or little similarity with the BIO/SEO dispute, fair enough, but to me there is a slight parallel.

Completely different cases i'm afraid, the one you highlighted was not in the same multi million pound catagory that the one here represents; remember Stanelco formed a whole new business unit called Ingel on the back of the stolen patent, remember too that Cardinal payed hundreds of thousands for a small stake in Ingel.

Costs alone will be worth the amount of damages outlined above.

Greekman,

As sham says, different case.

The point to bear in mind is that any damages awarded in the UK in relation to Patent infringement will not be punative. That is, the damages will relate directly to loss of income to the aggrieved party. In other words, a sum of money the defendant obtained through infringement of the Patent and which therefore the claiment lost.

Thats why the award is likely to be negligable in this case - SEO have not profitted from any ALLEDGED infringement (there were no sales to my knowledge). The case is all about the future - to establishlish future rights to use, not about monetary loss or gain. IMO.

Re my post of 11862.

This post has been taken by some on a competitors thread as intending to raise the patent dispute again which was not my intention. The competitors thread has a seperate discusion page for the said dispute. In the absence of such a page here I will remove said post if it is lickely to cause problems. I have always said it is up to the courts to decide. The subect is far more imotive than I thought. As said if it is going to cause the thread to move away from current issues such as greenseal/starpol ect it will be removed.

morning all. seq gone .... again!! greekman, no harm in leaving your post, but there really isn't any point in discussing the cc or damages because nobody knows for definate how much any damages are going to be.
i am really starting to get interested in this chart business. i know there are many knockers out there, but, chartists do seem make a lot of correct calls. can anybody recommend any good charting starter books?

Not worried but it had the effect of turning the other thread back to the patent dispute and away from the present, relevent issues such as greenseal and starpol, that was my reason for its removal. As all of us waiting for good news.
