My name is Mark running my company called Orient New Media Ltd (www.orientnewmedia.com) specializing on Chinese/Japanese online marketing/ translation//software localization and other IT service.
On 6, 7 and 8 June 2006, I received a phone call 3 times during these 3 days from Mr. Aaron Willis at Ufindus ltd. He pervaded me to buy his company's service package for Orient New Media
Ltd. On 8 June 2006, I was somehow headache that day and got touched by his words but only agreed to buy it at 2.99 pounds for testing in my intention. According to the voice clip Ms Elizabeth Richards at Ufindus Ltd sent to me later, I can confirm that he just said the whole package cost 299 pounds for 6 weeks and then 2.99 pounds per day after 6 weeks (he did not
specify how long this package will last and how much exactly in total he will charge me, he said "two nine nine pounds" instead of "two hundred ninety nine pounds" to confuse me). I just thought it might be just 2.99 pounds, then I agreed to pay by 2.99 pounds then i told him my credit card details. After the card was verified, he then told me I was charged at 423.00 pounds and this is 1 year contract. I told him to email or send me sth in writing and he promised.
On 8 June 2006, I found my credit card was debited 423.00 pounds.
I was contacted by nobody from Ufindus ltd until 16 June 2006. I received an email with an attachment for the invoice 1185.57 pounds (301.00 pounds setup charge + 59.00 x12 month + 17.5% VAT). I then telephoned their customer service 3 times during 21-23 June to report I do not require this service and total charge is not acceptable. But the service staff said only senior
position can deal with my request. Until 26 June, Ufindus's Customer Relations Case Officer Ms Elizabeth Richards telephoned me. After several times negotiation, she only admitted that the sales person Mr Aaron Willis did not specify the contract term duration but had informed me exact amount he would charge me.
As a result, on 27 June 2006, she changed my contract from 12 month mandate to (setup fee + 1 month charge) 423.00 pounds + month by month payment in the remaining 11 months ( I now can cancel this contract by mailing a letter to Ufindus ltd on 11 July). My contract now started from 8 June 2006 according to Ms Elizabeth Richards. I asked her if she charged me 423.00 pounds
for set up fee + 1 month, why she still set up my contract starting from 8 June 2006? The first contact to me from Ufindus Ltd is an email arriving my email account on 16 June 2006. Who shall pay for 8 days difference and what is points of I shall write to you on 11 July 2006 for 2 weeks advance notice (that means my 1 month contract finishes on 24 July 2006). She did not
clearly answered me these questions but just keep saying I will not be charged again if I write to Ufindus Ltd on 11 July for cancellation.
That seems Ufindus Ltd does not care how long and what I can receive this service but only wanted to charge me this 423.00 pounds at least.
I am vey angry with this rogue selling behavior and greedy customer service manner. The logics of Ufindus is anybody tending to buy their products will be forced to buy it and keep it
without rights to cancel. I argued this with Ms Elizabeth Richards. She insisted on
1. This deal is between company and company, therefore, I am not covered by any UK consumer protection act. I must pay for this contract.
2. I can not cancel it as I have agreed its price over the phone
3. Ms Elizabeth Richards repeatedly said that the sales calls from ufindus are just like many mobile phone sales calls, once you agreed to pay and paid over the phone, u will be legally
banded.
My points are
1. Mr Aaron Willis did not clearly repeat how much in total he will exactly charge me in the first time, even did not mention 423.00 pounds and 1185.57 pounds these 2 figures before he took
my credit card details. He kept saying "two nine nine pounds" instead of "two hundred ninety nine pounds" to confuse me
2. why i have no rights to cancel or return the service unused for getting refund? I did this transaction for my own company but why I can not cancel it even I never use this service and
write back to them for cancellation immediately after I received their first contact by email.
3. Even there is a similarity between mobile phone sales call and this case, the mobile phone sale callers usually clearly say how much they will exactly charge the buyers and usually any
buyers will get 7-14 days peace of mind no obligation return guarantee. Why that is not the case for Ufindus's sales according to Ms Elizabeth Richards.
4. If I agreed this contract over the phone, why Ms Elizabeth Richards admitted now Mr. Aaron Willis did not tell me the contract terms - 12 months on 8 June 2006. That means I actually was
not instructed the full terms of this contract as Mr. Aaron Willis did not give me the full correct information of the contract. So how could she adjust this as I partly agreed this
contract and forced me to pay 423.00 pounds?
5. Why I have to write to them in 2 weeks time advance to cancel this contract. Why they can set their own rules to force the customers to obey without telling them first before they buy?
6. Ms Elizabeth Richards told me over the phone that my contract started on 8 June 2006. I am very confused about what they charged me and the service terms I can use even if I had agreed this contract. Over the sales call, I was informed by Mr Aaron Willis that I would receive the emails and mailing package within 48 hours after I paid by credit card. But the first contact
actually arrives on 16 June 2006 by an email and so far I never received any mailing from Ufindus Ltd. Ms Elizabeth Richards explained to me that my address registered with them may be wrong, but I told her that it was not the case as my post code and first line of my registered address is perfectly correct. I believe Ufindus Ltd did not send me anything within 48 hours
after I paid by credit card. As so, I have reported to my credit card as a fraud investigation as I did not receive anything from Ufindus Ltd within the time limit they instructed me.
I also mentioned several times over the phone to Ms Elizabeth Richards that what she did against me might cause bad publicity for the company, But she seemed careless about what I said and told me to go ahead. I am very shocked at her response and let me associate ufindus and her as Mr. Shylock in THE MERCHANT OF VENICE
Ufindus Ltd's sales manner is just like many telephone sales rogues'. They are always looking at the profits but never care the customers' feeling. Ufindus Ltd is forcing people to buy the products they do not wiling to buy in my view from my experience this time.
Can you help me to get my refund back and cancellation of this outrageous contract?
