Re cc. The next hearing is I believe on the 18th. I suppose the question is whether seo will announce ASDA result before or after. My feeling is before. A good ASDA announcement going some way to minimise negative effects of cc. What do you think?

RE cc, the following extract is from Preliminary Results:

"... in the light of further evidence that has been identified since the original hearing, and on the basis of legal advice received, Stanelco beleives that it will be able to continue to pursue this area of technology. Stanelco will also be seeking leave to appeal the court's judgement."

The point is also made that: "InGel is important but no longer a key element in the success of the Group and, in mitigation untilmatters are resolved, we have reduced the resources on this project."

Eric, interesting to rehearse the exsiting arguments why cc not a real threat to the overall performance of the company, but what brought that on all of a sudden? Has someone been raising the issue again? It does seem limited solely to the soluble capusule/Ingel bit of the business, which as you say they have effectively put on the back burner. Note entirely convinced that they should or can go to appeal which would involve more costs from both sides potentially. Isn't there a settlemment in exchange for ongoing royalties that would be better for both sides, rather than continued uncertainty and ever increasing acrimony?

I'm happy to look into Bark To Basics, Bite The Kitten and Newfoundland Wags Tail, but am in imminent danger of having a new day job suggested if I spend any less time on it than currently! So give a me a little time, please.

SD. I agree. However, some were getting nervous again and there was reference to a court appearance on 16th March. According to the Prelims the situation is less clear-cut than assumed. Quote: "The court founf that one of the families (making capsules from two water-soluble films using RF) belonged to BioProgress (except for some of the claims in the patent which were awarded jointly to Stanelco and BioProgress) and two of the families were found to beleong to Stanelco (....). For reasons which Stanelco does not accept, it was found to have breached its duty of confidence to BioProgress."

The court appearance could be assessing Stanelco's liability in respect of costs and damages, but it also appears likely that SEO will be seeking leave to appeal. In any case, SEO are downplaying its significance and I suspect that the worst that can happen for them is that they have to drop some of the InGel development. I suspect B**G fans have been overstating the significance of the whole deal.

Pretty good effort and as good as the originals revealed to me (Bark to Basics could be a contributor to Bos's Band!): Buried The Bone; Banished to Kennel; No Walkies Today. Obviously been a naughty dog!

tipton: SEO don't need the exclusivity deal but ASDA do. Therefore, ASDA will be prepared to pay for the privilege! The other point is that, if ASDA are paying a given amount for a 12-month exclusive deal, they might as well start it as late as possible; they are already behaving as if it is a done deal.

sd: I seem to remember you saying that you were one of only two doing the job in Europe. Seems that we may need 20 questions to work that out (harking again to the past as we old stagers tend to do!). First question - how many in the USA?
