Institute of Psychiatry - It is most welcome that ACD2 corrects some of ACD1s errors and recommends both FearFighter for panic/phobia and Beating the Blues for depression, so widening the range of sufferers who will have more
choice and be able to access effective help quickly.
Clinical Expert 1 - I am also pleased that Beating the Blues continues to be recommended in 1.1 as an option for the treatment of mild and moderate depression.
Department of Health - We welcome your recommendations on Beating the Blues and Fearfighter.
Clinical Expert 3 - I would recommend the wording be changed slightly to There is insufficient evidence to recommend Cope and Overcoming Depression as cost effective options for the treatment of depression, except as part of ongoing or new clinical trials.etc
Media Innovations - We are quite happy to acknowledge that the evidence
base for Overcoming Depression is not as strong as yet
as for Beating the Blues.
and for balance...NHS Quality Improvement Scotland 2 - It would seem
appropriate to use the Scottish conclusion of Not proven for COPE and Overcoming Depression i.e. to reflect the situation that there is some evidence of
effectiveness, but evidence of efficacy is required through well planned RCT studies.
There are also a lot of comments from the Institute of Psychiatry regarding BTSteps (now called OCFighter). They seem to agree with St Solutions regarding relaxation being an appropriate comparator in RCTs. I strongly suspect that this is the point that they have appealed on (if it is them who has appealed). The DoH also seem to agree...
Department of Health - On OC Fighter I would be grateful if you could clarify and re-examine the view of relaxation as a comparator treatment. OC Fighter is more effective than relaxation but this appears to have been overlooked as evidence of effectiveness. The consultation suggests that it does not view relaxation as an example of usual treatment, even though it is often used in clinical practice.
I think at worst the appeal hearing could result in a slight re-wording of the FAD to make it clearer that COPE and Overcoming Depression should not be dismissed until further RCT evidence is available. However, the recommendation for BtB should be unaffected. All consultees seem to be in agreement that BtB is the most cost-effective and proven method for treatment of moderate/mild depression so I can't see this not being implemented. If further evidence becomes available on the other products then this can be considered when CCBT is reviewed (after 18 months I think - Sept '08). I can't see the current recommendation for BtB being effectively being put on hold just so the other 2 companies can gather further evidence - why wait when the most proven, cost-effective product is ready to roll??

Appeal
The Institute has received one appeal against the Final Appraisal Determination and Guidance on this technology. The appeal hearing is currently being arranged.
As set out in the Guidance for Appellants members of the public, including consultees and commentators for this appraisal, and the press, may request to attend the hearing. The number of observers admitted to the hearing will be limited to a number appropriate for the venue, and priority will be given to members of the public who are not employed by the appellant. Details of the hearing and how to register to attend will be posted on this page when they have been finalised. The Institute will not accept early requests to attend.
The name of the appellant will be published on this page on the day of the appeal. The Institute will not comment on speculation as to the identity of appellants prior to publication of this information on the Institutes website.

NICE has nearly completed its very structured due process of the above review. The last phase of the process provides an opportunity for appeal against the final drafting of the report and recommendations. We understand that an appeal has been made but we do not know by whom and on what grounds, NICE will not release any further details until the appeal is heard. A date has not been set for the hearing at this time.
We do not expect that the current draft will change in respect of Beating the Blues. The appeal process will extend the final date for Completion of the process and subsequent recommendation by up to 2 months. Whilst this is frustrating for all of us there is nothing we can do that will change this. The company and NICE has been inundated with calls and emails regarding this matter which is taking up valuable resource. Ultrasis will communicate, any further updates regarding the NICE timescales, via our website.
