I'm frankly surprised now at the optimism. I've looked at the Patent situation in a little more depth and I'm not convinced. I know I upset some people about
18 months ago when I raised the subject but I wasn't convinced then that IP was good and I'm still concerned. Some of you will know my professional background.

Apologies if my detailed post upsets any of you again, but I think it is time the subject was at least raised and debated especially as many of you are putting even more money into this company and any long term success relies totally on the Patent Protection.

This is my assessment of the Patent situation, based on details in the prospectus. As usual, DYOR.

Firstly Stanelco's (including Aquasol's) Patents.
information taken from 4.5, Discussion of individual Patent Familes.

Frogpack 4.5.9 Blanks for Containers (Quad Frog)

The patents are all pending, nothing granted - No guarantee that SEO will end up with any exclusive rights.

Greenseal

4.5.13 Food Packaging - patent application is pending;examination has
not been requested.Quote from prospectus 'The claims in their present form are not likely to be valid.'

4.5.14 Sealing Stanelco Trays - The patents are all pending, nothing granted - No guarantee that SEO will end up with any exclusive rights.

4.5.15 Dielectric Foam Barrier - The patents are all pending, nothing granted - No guarantee that SEO will end up with any exclusive rights.

4.5.17 Telescopic RF Connector - The patents are all pending, nothing granted - No guarantee that SEO will end up with any exclusive rights.

4.5.18 Thin-flanged Trays - abandoned, and a new UK patent application has been filed. No guarantee that SEO will end up with any exclusive rights.

4.5.19 Electrodes with Polymer Cladding - The patents are all pending, nothing granted - No guarantee that SEO will end up with any exclusive rights.

4.5.20 Matching Network with Linear Motors - The patent is pending, nothing granted - No guarantee that SEO will end up with any exclusive rights.

4.5.21 Deformable Welding Electrode - The patent is pending, nothing granted - No guarantee that SEO will end up with any exclusive rights.

So there we have it - no granted Patents relating to Greenseal of Frogpack. No guarantee that SEO will end up with exclusive rights to the technology. If Greenseal ever took off, as things stand there is no protection to stop anyone producing and using Greenseal technology. Thats not to say that the patents wont all go to grant and everything will be hunky dory. But that has not happened to date.


The Biotec Patents schedule in the prospectus is pretty incomplete informationwise! For example - HU0211429B and HU0068437A2 PROCESS FOR
PRODUCING OF POLYMER MIXTURE AND SHAPED BODY. Why no details? Is it in force? Dozens of others with no indication as to whether they are granted, pending or expired. They could have included an up to date detailed schedule for a small cost - why haven't they? Which are the key Starpol patents, and what is their status? Are they the highlighted details in the schedule? - thats what we need to know but the information is hidden! Why?

Many of these patents are fairly ancient and do not have a lot of life left in them (20 years max life for a patent - some date from 1989, many from early 90's). So, 3 or 4 years left and most of us say we're in for the long term. Is that long term?

I would have thought the prospectus could have been much clearer in telling us what patents relate to Starpol and what their status is.

I will have to do more research before I can tell what, if any, protection is in place.

Hope this is useful to some. I'm coming round to thinking that there are too many questions unanswered for me to confidently sink more money into SEO.

P.S. Can any one tell me what has happended to the contract which was in the final stages some 6 weeks ago, and the LOI's?

I agree that Starpol 3000 approval may be a key factor to certain US deals: if it does not receive approval, what little credibility SEO have left will be gone.

'Morning all

Just a reminder, my research on the 15th August revealed that the FDA approval for Starpol 3000 then, was due in 12-16 weeks, which now means that it is 3.5 - 7.5 weeks away.

I would suspect that if they are planning to invest in at least two manufacturing plants in the US at least one will be for Starpol 3000. Don't forget that Wal-Mart are testing Starpol 3000 at present in anticipation of approval for it being granted.

Another point, which some on here are overlooking, is that if the manufacturing plants are a success, then the market is going to grow exponentially with all the resulting effect on the share price.

Having said that, I do take notice of Oblomov's post 21395 above and realise that the future is not totally guaranteed and assured. Nothing in life is! We cannot even be sure of the sun rising tomorrow, anymore!!

Nothing in the future is guaranteed, Oliy, but the probability of it happening is increased with good IP, decreased with bad! Why pay a 45,000 Greenseal license fee to SEO if someone else comes up with the goods for 10,000 and is legally entitled to?

Looking back over the last 20/30 years at all the products in daily use, DDT,Asbestos,Tobacco to name but 4 (not great at percentages, but brill at maths) all thought to be harmless once, with the first 2 now banned (tobacco won't be, too much money in it!), who knows, they might ban plastics altogether when the more viable and safe products start to gain a lead.

'Submission' dates etc are in the prospectus - no one can say when a final decision will be made. Several in the schedule are still pending after 3 years. Many of the Greenseal patent applications went in 2004,2005 - some 2006, so add three years on to grant (assuming they reach grant). The main Frogpack Patent application dates from December 05, so add three years on to that before a decision.

The main Greenseal patent, i.e. WO (P.C.T.) GB_05_050178 , was filed on 10-Oct-05. Decision sometime 2008?

Whether the co has a product is totally immaterial short term just ride the technical wave set your out target price and make sure you bank some return. Sure you could miss the big wave up and in 5 years say wow I sold that share at 1.2p and now its 100p but there will be plenty of chaances to buy back in when the news is a bit more solid -- i.e. trade this baby and care not about the co's products

More conspiracy theories.

It was not an MM trade anyway. It was an AT trade. It came off the order book. Trades get matched and reduce a trade on the order book by the size of the executed trade. It often leaves odd numbers of shares to be executed as part of another trade.

I kind of half expected the SP to drop a fair bit this afternoon as traders took profits on the 30% rise since Monday, but it has not, so I assume much of the buying is shorters closing.

Presumably 1) refers to shares bought after the cut off date of 9th. Oct and not
covered by the open offer.

2) Those shareholders with shares bought up to the cut-off date who hold through crest accounts.

oblo - Thanks for the patent date info. For the main Greenseal one then, the Priority Date is round about 10 April 2004, i.e. ~ 18 months earlier with 20 years to run from that date, assuming it runs to grant.


For info, today's post brought my letter from Hargreaves Lansdown inviting an application of 3 new for 5 old held at close of business on 9th October 2006.

The Election Form to take up the offer kindly works out your new share entitlement (still worth checking it yourself, of course) and does not allow you to apply for any amount greater than this entitlement, although you can apply for fewer.
