ok, maybe i was a bit extreme in that point but it all gets very disracting. i think when there is clarity re sums at stake and potential liability then things will calm down.

Further Re: Termination of Agreement with Watermark Group plc ('Watermark')

The Directors of AeroBox note the announcement made by Watermark today and refer
to the AeroBox statement of earlier today. The Board of AeroBox strongly
disagrees with Watermark's allegations and remains confident of the strength of
AeroBox's position. AeroBox will strongly defend these claims.

The Directors also refer back to their trading statement of 25 June 2004 and
reiterate that these proceedings will not deflect AeroBox from the continuation
of its business and the implementation of its strategy.

I was intending to invest in both Watermark and Aerobox but just for the moment Aerobox is off the screen for me. Not only is the price in steep decline but the tone of Watermarks announcements indicates that they consider that they have a strong case.

I've seen what happens to small companies with court cases impending and it's not a pretty sight. I've suffered the losses too. If Watermarks contract is upheld I can see it costing Aerobox dear since Aerobox itself avers that there is an substantial market for it's product. The logic therefore must be that the loss to Watermark is all the greater and that would be reflected in any award the courts may make.

On the other hand, I can't see that Aerobox would gain anything from winning except independence. That would be positive in respect of the share price as long as solid sales and deliveries are forthcoming.

There is also the prospect of what Watermark may do if the price continues to fall. There is a possibility that if it gets too low Aerobox may not be able to fund development and production.

I did wonder if Watermark might settle the issue by buying Aerobox lock, stock and barrel. Although that depends upon how far the price falls and how tightly the shares are held. I suspect that some people might prefer to hold Watermark paper or cash rather than watch Aerobox go down the drain.

I shall be watching this share with great interest Good luck to all those already in.

i agree that Watermark seems to have more confidence in their announcement and Aerobox seems to be scrambling for cover in their press releases.

All i know is that i was seriously looking to invest in Aerobox once orders came in because i do believe they have potentially a global product on their hands. HOWEVER, as the wise Socrates notes, smaller companies become consumed and distracted by court cases and may run out of cash and be unable to raise more in the process.

stear clear unless you have really want to just buy and lock the stock in a draw for a while....or we see a speedy resolution and orders flying in (excuse the pun)

Well if ARX are really in the wrong and the potential court case is a significant threat to the viability of the business, they will be forced to move to an out of court settlement which would see the share price recover dramatically.

ARX management are a very experienced bunch. If they progress with the court case, they are going to be very sure of winning. WMK have more to gain than lose by pushing this court case.

Still great excuse for these artifically low prices which I will take full opportunity to accumulate.

I don`t know how many shifts they have working but it`s to my understanding that production should have increased by 40 to 400 units a month by September.

When they new production plant is up and running it will mean working on a three shift basis,a production of 3,600 ULDs per month.
