Re Court Case

In the latest development in its continuing dispute with BioProgress Technology
Limited, Stanelco RF Technologies Limited went back to court yesterday to argue
that evidence which had come to light within the last few weeks meant that the
court should reverse its finding of breach of confidence by Stanelco.

Stanelco's case was that the documents which had been found showed that the
information which BioProgress had argued at trial was confidential had actually
been in the public domain for over 40 years.

After a full day's hearing, the court reserved its judgement due to the
complexity of the issues which needed to be considered.

After the hearing, Ian Balchin, Chief Executive Officer of Stanelco, commented:

'We regard the fact that the court has needed to reserve its decision as an
indication of the seriousness of the point we've raised and its implications for
both parties. We look forward to receiving the court's decision. If Stanelco's
application is successful, we will not be liable to BioProgress at all in
respect of its claim for breach of confidence. If we don't succeed then, leaving
aside any costs issues, we'll be in just the same position as we are now'.

Yes this is interesting... Another RNS also regarding tray liding technology... Can't really see this decision going SEO's way but what do I know...

willfagg - 01 Dec 2004 09:32 - 345 of 27111

No i agree, but i think his comments again underline that an awareness of the possible worst case exists at SEO and they are not over concerned. Also i still think its already in the price which is why yet again any favourable news moves the price on.IMO

andysmith - 01 Dec 2004 13:29 - 346 of 27111

Way back on post96 I suggested >50p potential share price. Glad to see more people believe(hope) this possibility. Topped up again last week but held some funds back just in case we see 5p after the cc sorted. Lets hope for the ten bagger!! and possibly more. Earlier poster questioning profit from tray lidding, IT DOES THE JOB, IT SAVES MONEY, REDUCES TONNES PLASTIC, REDUCES PACKAGING/PRODUCT WASTE AND HAS THE BACKING OF THE RETAILERS WHO CAN AND DO SPECIFY TO THE PACKERS.It will make a lot of money once adopted, it may have a life-span but we could all make a killing over the next few years.
Asda trialling, possibly Sainsburys, can't wait for Tescos and Morrisons!! not forgetting the bio film, McDonalds?
So much potential!!!

bosley - 01 Dec 2004 13:35 - 347 of 27111

good afternoon gents. i think this is quite wonderful. the judge has gone from being very anti seo , to reserving judgement.far from being done and dusted this could now very much swing our way. if it is proven that the info was in the public domain , then bprg cant claim the patent. neither can seo. have i read it wrong? does this only affect the claim against breach of confidentiality? oh dear , its all gone confusing again........

DSTOREY9916 - 01 Dec 2004 14:03 - 348 of 27111

SEO are certainly dragging this one out! lETS ADMIT DEFEAT AND GET ON WITH THINGS!!

AdieH - 01 Dec 2004 14:07 - 349 of 27111

Totally agree DSTOREY9916, I can't see the judge reversing his original decsion, lets just get on this is only harming SEO and we cannot move forward until this is cleared, MANAGEMENT move on invest yr time and energy in the tray lidding technology, PLEASE.

superrod - 01 Dec 2004 17:29 - 350 of 27111

i agree totally that (TODAY) SEO could be a big winner for shareholders, but what if the packaging climate changes?

everyone and their mother is banging on about environmental issues these days.....am i the only one who thinks packaging is waaaaaaaaaaay overdone these days? a pound of mince comes in a vast polystyrene container for instance. i would personally prefer to buy in vacuum packed bags. ( forgive my ignorance as still on the sidelines with this one, but does SEO do that as well)?

mancharry1 - 02 Dec 2004 00:49 - 351 of 27111

Bosley, u were right! Who'd have thought after our conversation tuesday the news would come out over the court case as it did. Not that that bothered you either way. If you think about the amount of items packaged everyday especially at Asda for example , who make a lot of their own bread etc on premises, the potential is endless! Will there ever be a downturn in packaging? - I can't see it, we don't buy things that are not securely wrapped and sealed anymore! It keeps things fresher and shows they haven't been tampered with! The other benefit with SEO is they've just patented a new bio-degradable film for this process and as superrod says everyone is going on about that these days! 1.00 by next december perhaps?

bristlelad - 02 Dec 2004 11:08 - 352 of 27111

HI MANCHARRYI SWEET DREAMS / TAKING THE HARD STUFF//// IT NOT DOING YOU ANY GOOD ////////

bosley - 03 Dec 2004 00:10 - 353 of 27111

bristle, let the lad dream.its what keeps us all going. 1 by december 2010 would be fine with me. very , very brief mention in todays shares mag in the list of 52 week highs( THAT WAS IT , JUST IN THE LIST OF NEW HIGHS).anybody heard any more about who the other company seo was in discussions with when it announced the asda trial?

bosley - 04 Dec 2004 13:10 - 354 of 27111

quite happy and content that the price SEEMS to be stable at this level.i have a feeling that seo may have played a trump card last week in getting the judge to reconsider or hold off final judgement in the breach of contract part of seo's dispute with bprg.if the judge agrees that the information was indeed public knowledge for the last forty years it could change everything.things looking good at the moment.i have no idea who the mystery company is that seo is in talks with , and no idea when an announcement will be made.if anyone knows , speak up!one more bit of good news could push seo through to new highs and through resistance at7p.would be nice.......

mickeyskint - 06 Dec 2004 16:47 - 355 of 27111

Up 2+% today. Will it go through 7p. Any views?

MS

hlyeo98 - 07 Dec 2004 18:24 - 356 of 27111

It will definitely shoot past 7p ... just be patient

willfagg - 08 Dec 2004 12:55 - 357 of 27111

anyone know why 41 million shares sold at 10.00am today?

AdieH - 08 Dec 2004 14:35 - 358 of 27111

Price is going down and large volume, something seems to be up wonder if they have heard about the court case results... Can't think what else might be driving price down...

Biscuit - 08 Dec 2004 14:49 - 359 of 27111

strange as when the 41m were sold the price didn't move and the share sale wasn't delayed at all (usually delayed for 1 hour)

mickeyskint - 08 Dec 2004 15:20 - 360 of 27111

These could hit 4p. Got out yesterday. Got it right for a change.
