I assume from that they're getting what they need elsewhere - they wouldn't stop production until the patent dispute with Novamont is settled (1 or 2 years at the least) , would they?

Also from the prelims - 'We are advised that the proceedings are at an early stage and a judgment is not expected for a year or two at least.'


Thats what I meant by saying the patents dispute would finish SEO off - 2 years at least during which Sphere will go elsewhere and possibly set up arrangements they'll stay with after the dispute is settled. Biotec could be fatally injured by this dispute. IMO, whether in the right or not.

And during that period the promissory notes may come home to roost! Biotec will need something to keep them afloat, Sphere may want SEO to settle the debt to help do that.

Certainly worst case scenario and good to have that as a reasonably possible outcome.

From past performance {BPRG CC} SEO were very upbeat with their "defend rigorously" etc, ect.... Then had to pay 1m plus share the patent(s), so I'm not at all confident about this current patent dispute with Novamont.

Oblo,

Under the control of EKI, Biotec were successful against Biocorp Inc. & Novamont S. p. A. back in 2001. The case was decided on May 14 with damages of $1m awarded to Biotec.

On 2nd August 2001 Biotec then enetred into a "patent cross-licence agreement" with Novamont.

Biotec then granted EarthShell Corporation (EC) Exclusive licence on 29th July 2002 with Biotec KG recieving $100k monthly payments plus royalties payable to EKI.

Does anyone know if the EC agreement is still in force? Also, does Biotec recieve EC royalty payments?

Note:

The agreement identifies:

EKI: E. Khashoggi Industries, LLC, a Delaware limited liability company
Biotec KG: bio-tec Biologische Naturverpackungen GmbH & Co. KG, a German limited liability company
Biotec F&E: bio-tec Biologische Naturverpackungen Forschungs und Entwicklungs GmbH, a German limited liability company
Biotec: "Biotec KG" + "Biotec F&E"
Biotec Group: "Biotec" + "EKI"

I believe Delaware is a tax free state in USA,I once owned shares in a Co. on aim back in 2000,they moved out to Delaware and we the shareholders lost the lot basically.Murky waters!!
