Pensioner, 78, arrested on suspicion of murder after suspected burglar dies in tussle

A pensioner has been arrested after a suspected burglar was killed during a violent tussle at his home.

The 78-year-old was held on suspicion of murder after the 38-year-old died of his wounds in hospital in the early hours of Wednesday morning.

Police said the struggle broke out after the pensioner had found two men inside his home in South Park, Hither Green, south London shortly after midnight.

One suspect, armed with a screwdriver, forced the home-owner into his kitchen when he discovered them, while his accomplice went upstairs.

Detectives believe a struggle ensued between "one of the males and the home-owner" and the 38-year-old intruder was stabbed in the upper body.

He was later found collapsed in nearby Further Green Road by paramedics from London Ambulance Service, who took him to a central London hospital where he died at 3.37am. Police were unable to confirm whether the suspect had been stabbed with the screwdriver.

In a statement Scotland Yard said: “At 00:45hrs on Wednesday, 4 April, police were called by a home owner to reports of a burglary in progress at an address in South Park Crescent, Hither Green SE6, and a man injured.

“The 78-year-old resident found two males inside the address. A struggle ensued between one of the males and the home owner. The man, aged 37, sustained a stab wound to the upper body.”

The home owner suffered bruising to his arms and his injuries are not life threatening.

Police arrested him on suspicion of grievous bodily harm before then arresting him on suspicion of murder.

He was taken to a south London police station where he remains at this time.

The second suspect in the burglary fled the scene prior to police arrival and and is now being hunted by the Met’s Homicide and Major Crime Command.

Clearly "stand your ground" does not apply here. As for the burglar being hunted by the Met, I wouldn't hold your breath. There are dozens of killings of youngsters and other general mayhem at the head of the never moving queue. But it will have the manpower to grill this old chap for days.

Two males, (that's not one male, it's TWO males) break into the home of a 78 yr old single man.

The grammar is a bit crap, really. It reads:

I think it could be put a little better and would be much clearer too, if it said:

When he discovered them, one suspect, armed with a screwdriver, forced the home-owner into his kitchen, while his accomplice went upstairs.

The newspaper report goes on:

The term 'forced the home-owner into the kitchen' indicates to me, that the home-owner didn't go into the kitchen readily.

In any kitchen there are usually knives about the place. These are either in a drawer, on the worktop in a block or on magnets attached to the side wall.

The home-owner either grappled away the screwdriver from the burglar to stab him or grabbed a knife from the wall or block.

"Arrested for murder" means the police believed he must have grabbed the 'murder weapon' (be it knife or screwdriver) with prior intent to kill.

Yeah....

How would you or me feel if two burglars broke into our home?

The answer the police are looking for, so as to be able to arrest you for murder has to be something along the lines of:

"Clear-minded enough to want to grab or get a weapon for me to kill the intruder."

Prime Minister pledges to tackle 'burning injustice' of the gender pay gap

Britain's gender pay gap is a "burning injustice" which must be tackled as the whole of society will remain "poorer" if outdated employment practices go unchallenged, the Prime Minister warned on Tuesday.

In an article for The Telegraph, Theresa May admits that the gender pay figures make "uncomfortable reading" for many businesses as she compares today's battle for workplace equality to the struggle for universal suffrage a century ago.

The Prime Minister's article comes ahead of Wednesday's deadline for larger firms to disclose the average pay gap between male and female workers.

What is the law on self-defence?



A householder’s right to use force in self-defence when confronting a burglar in their home has been strengthened repeatedly in recent years.

Since 1967 it has been legal for anyone to use “reasonable” force to prevent crime or to apprehend an offender.


The controversy over the Norfolk farmer Tony Martin, who was jailed in 1999 for murder after shooting a teenage burglar as he fled, turned the legal definition into a hot political issue.

Martin was initially jailed for nine years but that was reduced to manslaughter on appeal and his sentence cut to three years.

The case provoked a series of legal reforms. The last Labour government enacted section 76 of the Criminal Justice and Immigration Act 2008, which enshrined the common law of self defence into statute, permitting the use of reasonable force when a defendant is confronted in their home.

The coalition government introduced extra protections. The justice secretary, Chris Grayling, supported a further clause, which came into force in 2013, permitting householders to resort to “disproportionate force”.

That principle was tested by the case of Denby Collins at the high court in 2016. Collins allegedly broke into a home and was restrained by the householder in a headlock which left him in a coma.


A legal challenge brought by Collins’ relatives claimed the law was incompatible with the right to life as guaranteed by the European convention on human rights.

But the judges ruled that force was not necessarily unreasonable and unlawful “simply because it is disproportionate – unless it is grossly disproportionate”.

How much force does it take to shove a screwdriver into a burglar's chest?

Varies really - all dependant upon your personal strength - and your attitude to being burgled.

If my home ever got burgled the amount of force would be less for me than it would be for my wife.

Cant escape the irony that the only suspect arrested in London following 39 murders was a 78 year old man defending his home and sick wife from intruders.
