Thought Id start this one going because its rather dead on this board at the moment and I suppose all my usual muckers are either at the Stella tennis event watching Dim Tim (lose again) or at Henly Regatta eating cucumber sandwiches (they wish,...NOT).

The death toll in the Italian cruise liner disaster has risen to six as investigators looked into reports that the ship's captain might have been "showing off" when he steered the vessel too close to rocks.

It is thought that Capt Chettino sailed as close to land as he did as he wanted to salute to a friend on shore.

Hmmm!! It would appear that we have gone from" Investigators looking into the possibility" To " Frivolous acts committed by the captain" Whats next? Guilty as hell Hang him????Speaking as one who works on the water,this ships every move has been recorded, and it would have a black box installed. Can an Executor and Trustee of a will transfer their "position" or "responsibility" for the actions defined in the will, onto another individual, if permission for doing so is not specified in that will?

I.e. nominate another person to be a trustee instead of them.

My thoughts are no, unless agreed by the other trustees.

One interesting possibility mentioned for hitting the rocks, was that there have been earthquakes etc. in that area or nearby, and that might have disrupted the sea bed.

But, as it seems to be an entrance to a small port and therefore probably utilised by a constant flow of shipping, one would have expected port officials to be aware of problems and notified all shipping.

Sad.

Try to evacuate 4000+ persons from a listing blacked out ship within 35 minutes which is the time scale for that type of ship with multiple flooding compartments. I am surprised that the casualty figure is not a lot higher.The fact that the ship was effectivly beached probably saved hundreds.And who's decision would that have been? The captains. People talk of panic! You cram 4000 very frightened people in to a large steel box and start sinking it, what would you expect?? After you Daphne!! Hmmm? There might be a clause about this in the Trust.

If not the Trustees could have a meeting (Minuted) and prepare a Written Resolution (Minuted) and then also Minute as to whether the Resolution was agreed upon.

This minute should be then be attached to the Trust Document and this action Minuted.

You might well need the services of a solicitor I feel.
